General Terms and Conditions of Sale
Preamble
These General Terms and Conditions of Sale (the “GTCS”) govern all orders placed on the Jack Gomme online store, accessible at www.jackgomme.com (the “Website”).
They define the respective rights and obligations of B&M SARL (hereinafter referred to as “we” or “us”), whose registered office is located at 46 rue de la Villette - 75019 Paris, registered in the Paris Trade and Companies Register under number 385 400 031, and of any person using the Website (hereinafter referred to as “you” or ‘your’), as a consumer.
By validating an order or by clicking on “I accept the terms and conditions of sale”, you acknowledge that you have read and accepted these Terms and Conditions of Sale without reservation.
Our Contract
All products offered for sale on the website are subject to availability.
Once finalized, your order constitutes acceptance of our offer, and in particular acceptance of the price quoted and the products designated. Consequently, when you confirm your order, you agree to be bound to our company by a sales contract, subject to the availability of the products and the validation of your payment under the conditions set out in article 7 below.
We remind you that this Website is intended exclusively for consumers. Purchases made from the Website are intended for your personal use, including for personal gifts, and may not be resold, used in a commercial context or used for commercial gain. We reserve the right to refuse orders for multiple quantities of the same item from a single customer or to a single postal address.
Article 1 – Purpose
The purpose of the General Terms and Conditions of Sale is to define the mutual rights and obligations of the parties and the various stages of the ordering process via the Web Site: from the selection of products through the ordering process to payment and delivery.
Article 2 – Products
The products offered for sale are those shown on the website on the day of consultation, while stocks last.
Should a product be unavailable for more than 30 days after order and payment, the customer will be informed by e-mail.
Product descriptions and visuals are given for information only and are not contractual. B&M cannot be held responsible for any errors or omissions.
Article 3 – Prices
Prices are displayed in Euros, Dollars, Canadian Dollars, Australian Dollars, Hong Kong Dollars, Singapore Dollars, Yen, Won and New Shekel, all taxes included (VAT included), excluding delivery and packaging costs, specified to the customer at the time of final validation of the order.
B&M reserves the right to modify its prices at any time, but products are invoiced according to the rates in effect at the time of the order.
The prices indicated are guaranteed within the limits of available stocks, except in the event of major changes in charges, including VAT, and except in the event of typographical error or omission.
If B&M identifies a pricing error displayed on the website for an order already placed, regardless of the reason (manual or technical error), the customer will be informed as soon as possible.
B&M reserves the right to cancel the order for any product affected by an obvious pricing error. If payment has already been made, the customer will be immediately refunded the amount paid. The customer may, if they wish, place the order again at the corrected and accurate price, subject to stock availability.
The products remain the property of B&M until full payment has been received.
For orders delivered outside the European Union, applicable duties and taxes may be covered by Jack Gomme.
Article 4 – Orders
4.1 – Order Process
Customers interested in an item displayed on the www.jackgomme.com website may order directly from the site: www.jackgomme.com.
Customers ordering directly from the www.jackgomme.com website must follow the following procedure:
- When placing their first order, customers must fill in a form containing the following information: title, surname, first name, full delivery address, e-mail address and telephone number.
It is not mandatory to open a personal customer account to place an Order on the Site. The customer may order one or more products, either through his or her customer account, or as a guest.
- The customer will select the various products in which he or she is interested, and then click on the “Add to my basket” link. At any time, the customer may :
* Obtain a summary of the products selected by clicking on the “Shopping Cart” link
* Continue shopping by clicking on the “Continue Shopping” link
* Complete your selection and place your order by clicking on the “Finalize your order” link
- To order the products selected, the customer must identify himself by entering his e-mail address and password, or continue as a guest. The customer is informed and accepts that entering these two identifiers (e-mail address and password) is proof of identity and consent.
- If the customer has not registered beforehand, he/she must fill in the form that will appear automatically when placing his/her first order, or fill it in beforehand by going to the “My account” section and clicking on the “Register” link.
Once the user has been identified, he/she must validate the delivery address, and an order form will appear summarizing: the nature, quantity and price of the products selected by the user, as well as the chosen method of payment, the user's contact details and the delivery address for the parcel.
4.2 – Confirmation
Once the customer has checked the status of their order, and once all the requested information has been completed, they click on “Validate” to definitively confirm their order. Once the payment method has been validated, the order is considered definitive, with the effects indicated below.
* Payment by credit card via Société Générale (Sogenactif), Paypal, Apple Pay or Alma.
The customer validates his/her address, the product(s) and the total price. The customer must provide his/her credit card number, expiry date and cryptogram number (3-digit number on the back of the credit card).
A confirmation email will be sent. For orders over 300 euros, proof of identity may be required.
Article 5 – Payment
Payment is made by credit card (Carte Bleue, Visa, Mastercard, American Express) via the secure Sogenactif platform, PayPal, Apple Pay, or an Alma account.
B&M reserves the right to refuse an order in case of prior dispute or payment failure. B&M’s liability cannot be engaged on this basis.
For any amount over one hundred and twenty euros, in accordance with article L.134-2 of the Consumer Code, B&M will archive proof of the written sales agreement on paper or electronic media for the legally applicable periods. The client has access to this document at any time upon request to B&M by providing proof of identity and a contribution towards sending costs.
Article 6 – Payment Security
Online payments on www.jackgomme.com are secured via the Sogenactif service. The client’s banking data (card number, expiry date, security code) are encrypted and transmitted directly to the bank, without passing through B&M’s servers. Once the order is confirmed, the payment request is processed in real time by Sogenactif, which requests authorization from the banking network and issues an electronic certificate.
Article 7 – Signature and Proof
For all credit card payments on www.jackgomme.com, the electronic certificate issued by the payment manager shall serve as proof of the amount and date of the transaction, pursuant to articles 1316 and following of the Civil Code as well as B&M’s electronic archiving systems.
Server date and time shall be binding between parties. In all cases, the validation of the order, whether the payment is made by credit card directly on the site, constitutes signature and express acceptance of all operations performed on the site.
However, the due date for payments is as set forth in article 4.2 according to the payment type and method.
Article 8 – Offers and Promotional Codes
Promotional codes:
* Do not apply to shipping fees unless otherwise specified
* Are not cumulative with other promotions and exceptional offers unless otherwise specified
Article 9 – Delivery
Products are shipped to the delivery address provided at the time of order, accompanied by a delivery note. B&M reserves the right to refuse deliveries to collective addresses (offices, healthcare establishments, etc.). In the event of delivery to a collective address, B&M’s responsibility ceases upon handover of the package to said address.
Orders are shipped within 7 working days. Orders validated on Friday may be shipped starting the following Tuesday. Delivery times indicated are approximate and start from the day following order confirmation. They correspond to processing and delivery times and may be longer during peak periods (Christmas, sales, etc.). In case of unusual delay, an information email will be sent.
Transportation risks are borne by the client. B&M declines all responsibility for delivery delays caused by postal or transport services, loss of ordered products, or strikes. In case of damage or loss, the client must file a justified claim with the carrier within 3 working days following delivery.
The client must verify the order upon receipt. Any anomaly (missing or damaged product, etc.) must be reported to customer service within 3 days of receipt by email at [email protected].
Claims made after this period will not be accepted. B&M reserves the right to request product return for verification before issuing a credit note, refund, or replacement.
Online sales are reserved for deliveries to France, Europe, the United States, Japan, Canada, Australia, New Zealand, South Korea, Hong Kong, Israel, Singapore, Andorra, Malta, Monaco, and the United Kingdom. This list is non-exhaustive and may be modified by B&M at any time.
Article 10 – Availability
Products are offered while stocks last. In case of unavailability after order confirmation, the client will be informed by email as soon as possible. The order will be canceled and refunded automatically within 30 days.
Article 11 – Right of Withdrawal
In accordance with the law, the client has a period of 14 days from receipt of the order to exercise their right of withdrawal without justification, pursuant to articles L121 et seq. of the Consumer Code. Return shipping costs are borne by the client.
If the client exercises the right of withdrawal, B&M commits to refund the amounts paid within 30 days by the originally chosen payment method. Sale, discounted, or private sale products are not refundable but may be subject to a store credit.
Items must be returned in their original condition and packaging. Returns of worn bags or used shoes, as well as damaged boxes, will be refused. The client must retain proof of return, meaning items should be returned via registered mail or any other method providing a guaranteed date.
In case of delivery error, return shipping costs will be reimbursed upon presentation of proof. The right of withdrawal also applies before delivery.
Article 12 – Return Conditions
All products (unless otherwise specified) may be refunded or exchanged for a credit within 14 days after receipt of the order or in‑store purchase.
As a reminder, only items returned in their original packaging (shoe box, plastic pouches, etc.) will be accepted. Consequently, returns of worn bags as well as damaged boxes will be refused.

Return shipping costs are the responsibility of the customer, except in the case of an error by B&M, and you are free to choose the shipping method.
In the event of a delivery error, B&M will cover your return shipping costs up to the amount shown on the proof of postage that you send us by email.
Requests must be submitted via the “Return Request” section in the customer account area, or by email at [email protected].
12.1 On the website
Store Credit
The credit note is valid for 12 months from its date of issue. It is available in your customer account and will automatically be offered as a payment method for a future order. This credit note can be used in one or several transactions, both in our stores and on our website.
If the amount of your next order is lower than the value of your credit note, the remaining balance will be added back to your account immediately after the order.
After Jack Gomme receives and validates the returned product, a credit note equal to the price of the product will be issued, allowing you to order a replacement product or any other item on the Website.
In the event of loss or theft of the credit note, Jack Gomme cannot be held responsible.
Refund
A refund request may be made by the customer within 14 days following receipt of their order. B&M undertakes to refund the amounts paid within a maximum period of 30 days.
The products are covered by the legal warranties, including those provided under Articles 1641 and following of the French Civil Code. Any warranty shall apply only on the condition that the damage was not caused by the customer due to negligence, deterioration, or improper use of the product.
After Jack Gomme has received and validated the returned product, a refund equal to the price of the product will be issued using the same payment method used for the original order.
Exchange
Possible within 14 days of receipt, within 30 days maximum after product return. Return costs are borne by the client except in case of B&M error. Requests must be made as above.
Once the product to exchange is received, the client will receive a gift card of the order amount to purchase the replacement product on jackgomme.com.
12.2 In store
Store Credit
The credit note is valid for 12 months from its date of issue and is available in your customer account. You will need to provide the credit note code to the store staff at checkout. This credit note can be used in one or several transactions, both in our boutiques and on our website.
If the amount of your next order is lower than the value of your credit note, the remaining balance will be added back to your account immediately after the order.
After the store staff has received and validated the returned product, a credit note equal to the price of the product will be issued.
In the event of loss or theft of the credit note, Jack Gomme cannot be held responsible.
Refund
Any refund processed in store is issued exclusively in the form of a credit note.
Exchange
Exchanges are possible within 14 days following the in‑store purchase or the receipt of the parcel for orders placed on the e‑shop, subject to product availability.
Requests must be made directly at one of our boutiques or through our customer service at [email protected].
Article 13 – Warranty Conditions
All our products benefit from a legal warranty of conformity and a one‑year commercial warranty, starting from the date of purchase, covering manufacturing defects.
This warranty covers exclusively defects related to manufacturing or materials. It does not apply in cases of:
- normal wear and tear resulting from regular use,
- prolonged exposure to adverse conditions (sun, humidity, friction, etc.),
- improper use or inadequate care,
- accidental damage (stains, snags, falls, etc.),
- modification or repair not carried out by our after‑sales service.
In the event of a claim, the customer must provide proof of purchase and, if necessary, photos of the defect observed.
If the product falls within the scope of the warranty, a repair, exchange, or credit note will be offered, depending on the situation.

Article 14 – Website Use and Intellectual Property
The website jackgomme.com, hosted on the Shopify platform, as well as all of its components (including texts, visuals, logos, photographs, videos, graphics, technical elements, domain name, overall site structure, product descriptions, etc.), are the exclusive property of B&M and are protected by copyright, trademark, and patent laws.
Access to the website does not grant the user any intellectual property rights over any of its elements, all of which remain the exclusive property of B&M or its partners.
The user is granted only a personal, non‑exclusive, non‑transferable right of use, limited to browsing the site and making purchases through the online store.
Any reproduction, representation, use, adaptation, publication, transmission, or distribution—whether in whole or in part—of the website or any of its elements, for purposes other than strictly personal and private use, requires prior written authorization from B&M and may result in legal action in the event of non‑compliance.
Any hyperlink redirecting to the Site and using framing or in‑line linking techniques is strictly prohibited. In all cases, any link, even tacitly authorized, must be removed upon B&M’s simple request.
The company reserves the right to suspend or revoke a user’s access to the site or to their customer account in the event of fraudulent use or non‑compliance with these terms.
Hyperlinks may direct users to websites other than this one. B&M shall not be held liable if the content of those external sites violates applicable laws or regulations.
B&M disclaims all responsibility for the content of third‑party sites to which links may refer.
Article 15 – Liability
B&M strives to ensure access to the site, proper order processing, and delivery in the best conditions but is only subject to a best-efforts obligation at each stage from site access to order, shipment, and after-sales services.
B&M cannot be held responsible for:
- Inconveniences or damages linked to internet use such as service outages, external intrusions, viruses, data loss, or other disruptions beyond its control
- Malfunctions attributable to third parties (technical providers, delivery services)
- Indirect damages including lost opportunities, data, clientele, or revenue
- Events qualified as force majeure preventing total or partial performance according to law and jurisprudence
Article 16 – Personal Data
16.1 – Data processing
Personal data are necessary for order processing and may be transmitted to B&M’s partners. Clients can object or exercise access, correction, and opposition rights by writing to:

In accordance with the French law of January 6, 1978, the consumer also has the right to access and rectify any personal information concerning them held in B&M’s files.
This processing is carried out in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (“Informatique et Libertés”).
16.2 – Data Protection
Collected data includes:
- Account creation: name, email, phone, postal address
- Connection: login, usage, location, payment data
- Profile: address, phone as per service use
- Payment: banking or card data
- Communication: content of member exchanges (temporary storage)
- Cookies: used for site functionality, can be disabled in browser settings
Data use:
- Enable access and improve services
- Ensure site security
- Manage payments, accounts, communications, assistance
- Display personalized content
- Prevent fraud and manage disputes
- Send commercial communications per preferences
Data sharing:
The data may be shared in the following cases:
- When the user uses payment services, the website interacts with third‑party banking and financial institutions with which it has established agreements;
- When the user publishes information in the website’s public comment areas;
- When the user authorizes a third‑party website to access their data;
- When the website uses service providers to deliver user support, advertising, and payment services. These providers have limited access to user data as part of performing their services and are contractually obligated to use the data in compliance with applicable personal data protection regulations;
If required by law, the website may transmit data to respond to claims made against it and comply with administrative or judicial procedures;
If the website is involved in a merger, acquisition, asset transfer, or insolvency proceedings, it may be required to transfer or share all or part of its assets, including personal data. In such a case, users will be informed before any personal data is transferred to a third party.
Security:
The website implements organizational, technical, software, and physical security measures to protect personal data from alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and the website cannot guarantee the security of the transmission or storage of information over the Internet.

Clause changes:
The website reserves the right to modify this personal data protection clause at any time. If any changes are made to this clause, the website undertakes to publish the updated version on its site. If the user does not agree with the new terms of the personal data protection clause, they have the option to delete their account.
Article 17 – Partial Invalidity
If any clause of this contract is rendered null and void due to a change in legislation, regulation, or by a court decision, this shall in no way affect the validity or enforceability of the present General Terms and Conditions of Sale.
Article 18 – Entire Agreement
The present General Terms and Conditions of Sale and the order summary sent to the customer form a contractual whole and constitute the entirety of the contractual relationship between the parties.
Article 19 – T&Cs Modifications
B&M reserves the right to modify the General Terms and Conditions of Sale. Any new version will be announced beforehand on the main page of the “My Account” section. Members who do not wish their contractual relationship to be governed by the new version of the General Terms and Conditions of Sale must notify B&M and, as of the date on which the new version takes effect, must cease using B&M’s services.
If any provision of the General Terms and Conditions of Sale is deemed illegal or unenforceable by a court decision, the remaining provisions shall remain in full force and effect.
Article 20 – Absolute necessity
If the company is prevented from performing all or part of its obligations due to a fortuitous event or a case of force majeure that hinders or delays their execution, such performance shall be suspended. Such events include all situations recognized as force majeure under French case law.
In such a case, B&M will inform its customers by email within seven days.
Article 21 – Governing Law and Jurisdiction
The contract is subject to French law.
- For disputes with professionals, only Paris courts have jurisdiction.
- For disputes with consumers, only French courts have jurisdiction.
